Terms of Use

The deal

• Every donated item is listed and claimed at $0. Donors are not paid for the goods.
• Local pickup is $0 shipping and $0 service fee.
• Ship claims pay all-in shipping (carrier quote plus a small packaging buffer) plus a $2.99 Gift N Thrift service fee. Card charges are processed by Stripe for SOTF Express Publishing, LLC.
• Vehicles and some categories require pickup and cannot be shipped.

Accounts

You must provide accurate account information and keep your password private. You are responsible for activity under your account. You must be old enough to form a binding contract in your state (and at least 13).

Your responsibilities

• Donors list only items they have the right to give away, describe them honestly, pack ship claims safely, and arrange pickup when that is the claim type.
• Claimers pay any ship fees due, provide a deliverable address (or show up for pickup), and accept items as described, secondhand, and without warranty from Gift N Thrift.
• Do not harass other users, scrape the service abusively, or interfere with the site or apps.

Prohibited items

You may not list or claim anything illegal to transfer, including but not limited to: weapons or explosives, illegal drugs or drug paraphernalia, stolen goods, counterfeit goods, hazardous materials that carriers won’t ship, adult sexual content or services, or anything that violates U.S. or local law. We may remove listings and suspend accounts that break this rule.

Tax

Gift N Thrift receipts are records of the transfer for the donor’s files — not tax advice, not IRS Form 8283, and not a promise that the gift is deductible. U.S. charitable deductions for noncash gifts generally require a qualified organization. Talk to a tax professional.

Payments and refunds

Ship fees are charged when you complete Stripe Checkout. If a ship claim is refunded through Stripe, related partner credits may be reversed. Pickup claims have no payment. Disputes about an item’s condition are between donor and claimer first; email contact@giftnthrift.com if you need help.

Disclaimer and liability limit

Gift N Thrift is provided “as is.” Donated goods are used and may have wear. To the fullest extent allowed by law, SOTF Express Publishing, LLC is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of the service or any donated item. Our total liability for any claim related to the service is limited to the greater of (a) the fees you paid us for that claim in the three months before the dispute or (b) $50. Some states do not allow certain limits; in those states our liability is limited to the maximum permitted.

Changes and termination

We may update these terms or the service. Continued use after a change means you accept the new terms. We may suspend or end access for violations, fraud risk, or to protect users. You may stop using Gift N Thrift at any time.

Governing law

These terms are governed by the laws of the United States and the State of California, without regard to conflict of law rules, unless your local consumer law requires otherwise.
